Explained by NH Supreme Court as:

 

__Use Variance “allows the applicant to undertake a use which the zoning ordinance prohibits” –for example, stabling horses in a district where keeping livestock is prohibited, or building a hotel in a strictly residential district.

 

__Area Variance – “authorizes deviations from restrictions which relate to a permitted use.”  For example, if a hotel is a permitted use in a district, but the ordinance prohibits buildings taller than 40 feet, an applicant might request an area variance to build a taller hotel, or an area variance may be requested to build closer to the boundary lines than the ordinance permits.

The Applicant is responsible for supplying the names and addresses of all *abutters to the property concerned including the names and addresses of any Engineer, Architect, Land Surveyor or Soil Scientist whose professional seal appears on the plat and holders of Conservation, Preservation or Agricultural Preservation Restrictions per RSA 477:45.

*For purposes of Notification:  RSA 672:3-“Abutter” means any person whose property is located in NH and adjoins or is directly across the street or stream from the land under consideration…
