Zoning Board of Adjustment Minutes

August 4, 2009 Public Hearing/Meeting

Amended and approved December 1, 2009

 

Roll call:  Chairman Richard Parker, John Andreasse and Michael Schwotzer

 

Meeting was called to order at 7:30 pm. 

 

Application of Lewis and Stacey Eaton, 204 South Road , Kensington, NH, Map 2, Lot 16-7, for an amendment to their previously approved Special Exception for Home Occupation for operation of a small winery in accordance with Ch. II, Article 8.4.C of the Zoning Ordinance and Land Use Regulation to include a sign.  Although approved for a Special Exception November 5, 2008, the Eatons did not believe they would be having a sign and agreed to reapply to the Board if they changed their mind.  The Eaton’s explained that they had not anticipated that their customers would have a hard time finding them and since they share a driveway the customers sometimes pull into their neighbors.

 

Richard Parker read the ordinance and John Andreasse clarified the amount of business as home occupations are intended to be incidental.  Stacey presented a design for a sign which will hold either an ‘open’ designation or a ‘call for appointment’.  The Eatons added that they are only open seasonally as they do not heat the room and plan to do most of their business by appointment.

 

John Andreasse moved to approve the application for a sign in accordance with the ordinance and an approved sign permit by the Building Inspector, seconded by M. Schwotzer with all in favor.  M. Schwotzer explained that under the ordinance a sign is a structure thus subject to the 25’ setback from property lines. 

 

Approval of May 5 and June 2, 2009 minutes - postponed

 

Adjournment – M. Schwotzer moved to adjourn at 8:15 pm, seconded by John Andreasse with all in favor.
