Zoning Board of Adjustment Minutes

June 2, 2009 Public Meeting

Amended and approved December 1, 2009

Roll call:  Vice Chair Joan Skewes, John Andreasse and Dan Chaisson

Meeting was called to order at 7:35 pm – no public was in attendance.

Joan Skewes read the agenda explaining that this was a Motion to Reconsider their decision of May 5, 2009 regarding Peter Kuegel, which was to not hear the application due to lack of jurisdiction on the advice of Town Counsel.  Town Counsel had advised that per RSA 155E, only the regulator has jurisdiction and in Kensington the regulator is the Planning Board.  The town could have chosen the regulator to be the Selectmen, the Planning Board or the Zoning Board of Adjustment, but only one of them, not a combination of them per RSA 155-E:1, III(a).  Therefore, she reiterated, the Kensington Zoning Board of Adjustment has no jurisdiction over this application. 

John Andreasse moved to uphold the decision made on May 5, 2009, seconded by Dan Chaisson with all in favor.

Approval of May 5, 2009 minutes – Postponed

Adjournment – John Andreasse moved to adjourn at 7:40 pm, seconded by Dan Chaisson with all in favor.
