May 5, 2009 Public Hearing/Meeting

Roll call: Vice Chair Joan Skewes, John Andreasse and alternate David Buxton filling in for Dan Chaisson
Meeting was called to order at 7:30 pm.
Joan Skewes read the agenda explaining that this was a continuation of the April 7, 2009 meeting:
Application of Peter Kuegel, 250 North Haverhill Road, Kensington, NH, Map 11, Lot 7, for:
1) An Appeal from an Administrative decision in accordance with NH State Statutes, RSA Chapter 677.
2) A request for a variance from Chapter V, Article I (10)i of the Zoning Ordinance and Land Use Regulations in order to permit the importation of concrete, brick and asphalt for processing with other gravel.
She explained that the Board had received advice from Town Counsel that the Zoning Board of Adjustment cannot take jurisdiction, thus cannot hear the case.
Attorney Daniel Jones, representing Peter Kuegel, requested the minutes reflect that he had asked for a full and disinterested board for the variance. Joan Skewes reiterated that they cannot take jurisdiction for either.
John Andreasse moved to not hear the application due to lack of jurisdiction on the advice of Town Counsel, seconded by Joan Skewes with all in favor.
Approval of April 7, 2009 minutes – John Andreasse moved to accept the minutes of April 7, 2009 as written, seconded Joan Skewes with all in favor.
Adjournment – John Andreasse moved to adjourn at 7:40 pm, seconded by Joan Skewes with all in favor.
