Zoning Board of Adjustment Minutes

April 7, 2009 Public Hearing/Meeting

Approved May 5, 2007

Roll call:  Chairman Richard Parker, Vice Chair Joan Skewes, John Andreasse and alternate Michael Schwotzer

Meeting was called to order at 7:30 pm. 

M. Schwotzer recused.  Chairman Richard Parker requested recusal from the hearing as well stating he has worked in the past for Mr. Kuegel and many of the residents on Osgood Road.  He also requested seeking Town Counsel on the matter.  John Andreasse countered that his experience is what was needed and Joan Skewes added that she did not feel those interactions required he recuse.

Dick Parker explained that he has knowledge of courts and conflicts of interest.  Since this matter has already been filed in court, he argued that counsel be sought.

Attorney Daniel Jones, representing Peter Kuegel, requested a full board, thus the hearing was continued.  Joan Skewes moved to continue the hearing to May 5, 2009 at 7:30 pm at the same location, seconded by John Andreasse with all in favor. 

The issues for counsel include:

· Conflict of interest – Dick Parker to recuse.

· Full Board – appointment of alternates.

· How does the current court case affect the proceedings?

· Can the Board grant a variance to the prior court case?

John Andreasse moved that the Board seek the advice of Town Counsel on all issues, seconded by Joan Skewes with all in favor.

Approval of November 5, 2008 minutes – Joan Skewes moved to accept the minutes of November 5, 2008, seconded John Andreasse with Skewes, Andreasse and Parker voting in favor.  M. Schwotzer abstained.

Adjournment – John Andreasse moved to adjourn at 8:10 pm, seconded by Joan Skewes with all in favor.
