Zoning Board of Adjustment Minutes

August 29, 2006 Public Hearing/Work Session Meeting

Approved October 3, 2006

 

Roll call: Richard Parker, Chairman, Dan Chaisson, Eric Peterson and John Andreasse.  Vice Chair Joan Skewes and alternate, Michael Schwotzer, arrived at 7:30 pm.

 

Meeting was called to order at 7:10 pm.

             

7:00 PM - Work Session for review of board rules and procedures – Chairman Parker provided a template for possible revision of the current rules of procedure.  Consensus for areas of improvement included spending less time on individual issues and following the rules more rigidly, however it was emphasized that they would like to continue to be flexible with the structure of the meeting on a case by case basis. 

 

7:30 PM – Motion for Rehearing – Consideration of a Motion for Rehearing filed by Attorney Mary Keohan Ganz, Ganz Law Office, for Charles Fanaras, Jr., 89 Amesbury Road.  The Board conducted a site visit and Mr. Fanaras described the difficulties and financial hardship that would result from relocating the garage.  The locations of the well, septic, wetlands and lot lines were reviewed.  Mr. Fanaras stated that moving the location of the garage away from the wetland boundary would put it in front of his house, devaluing it.  All returned to the town hall at 7:58 pm.

      Eric Peterson recused as he felt he had not heard the previous case and would not have a basis to rule on the merits of the appeal.  Alternate M. Schwotzer was asked to fill in.  Members discussed whether there was additional information brought forth for consideration.  Dan Chaisson moved to grant the rehearing as enough evidence was presented on the wetland setback, seconded by Joan Skewes with three in favor and two opposed.  Attorney Ganz will prepare an application for an October 3 meeting and include a complete package.

 

Approval of July 5, 2006 minutes – postponed to the next meeting.

 

Any other Board business – Joan Skewes raised concerns with an applicant withdrawing before a decision is rendered and then resubmitting.  Denise will contact Town Counsel and convey the findings to Chairman Parker.

 

Adjournment – John Andreasse moved to adjourn at 8:25 pm, seconded by Dan Chaisson with all in favor.
