December 6, 2005 Public Hearing/Meeting

Roll call: Chairman Richard Parker, Joan Skewes, Dan Chaisson, John Andreasse, and Michael Schwotzer

 

Meeting was called to order at 7:30 pm.

             

Continued - Charles Fanaras, 89 Amesbury Road, Map 11, Lot 11A.  The applicant is requesting an Area Variance to Chapter II, Article 8.3, C.1 to build a garage less than the required 25’ from abutting property. 

      Mr. Fanaras reported that his surveyor, Paul Nichols, has found a discrepancy in the location of one boundary marker and is still in the process of resolving the issue.  He said Mr. Nichols felt he would have the plans ready for the January meeting.  John Andreasse moved to continue this application to January 3, 2006, seconded by Dan Chaisson with all in favor.

 

New Public Hearing - Neil Moore of 112 South Road, Map 4, Lot 44-1 The applicant is requesting a Special Exception for Home Occupation in accordance with Chapter II, Article 8.4C to refinish and sell used furniture and other small items from the garage. 

      Mr. Moore presented his application to refinish furniture from his garage.  Abutter, Carolyn Doran stated she was in favor of the proposal.  Abutters David and Sally Buchannan stated they had numerous concerns including sale of items outside the garage, the number of pieces in storage, use of chemicals, hours of operation, and lighting.  Board members explained that all of these could be addressed under conditions of approval.

      Board members reviewed the ordinance which requires that the home occupation be within the dwelling.  A letter from Town Counsel regarding a similar 1999 proposal was read confirming this.  Mr. Moore explained that there was no area within the home that he could use at this time.  John Andreasse moved to deny the application due to not meeting the criteria, specifically the dwelling unit criteria.  M. Schwotzer seconded the motion with all in favor.  The members agreed to discuss possible changes to the Home Occupation ordinance at their next meeting.

 

Approval of October 4 and November 1, 2005 minutes - John Andreasse moved to approve the minutes of October 4, 2005 as written, seconded by M. Schwotzer with all in favor.  M. Schwotzer moved to approve the minutes of November 1, 2005 as written, seconded by Joan Skewes with all in favor.

 

Adjournment – M. Schwotzer moved to adjourn at 9:01, seconded by John Andreasse with all in favor.
