Zoning Board or Adjustment Minutes

June 1, 2004 Public Hearing/Meeting

Roll call: Chairman Richard Parker, Joan Skewes, Daniel Chaisson, and alternate, John Andreasse sitting in as a full member

 

The meeting was called to order at 7:45 p.m.

 

Continuation of the Application of John and Ruth Doyle, 60 Cottage Road, Kensington, NH, Map 8, Lot 41, for a Special Exception in accordance with Article 8.4 A.5 for an In-Law Apartment.  Mr. Doyle was not in attendance nor has any correspondence been received from him.  Chairman Parker reviewed that some verification was needed to ascertain that there isn’t a health issue due to a substandard septic system.  Joan Skewes suggested a letter be sent to the Selectmen that the Zoning Board of Adjustment has been reviewing this application and the requested information has not been received.  Since this in-law apartment was built prior to Mr. Doyle coming to the Board, he is violation and we are referring the matter to the Board of Selectmen for enforcement.  John Andreasse moved to deny the request due to failure of the applicant to provide the requested health information or ask for a continuance, seconded by Joan Skewes with all in favor.

 

Application of James and Susan Farley, 11 Old Amesbury Road, Kensington, NH, Map 3, Lot 5, for a variance from provisions in Article 8.3, Section C2, of the Zoning Ordinance and Land Use Regulations, which requires “…a minimum depth of 25 feet between the nearest right-of-way and any structure”.  The applicants wish to build a farmer’s porch on the front of the house.  Dimensions will result in the porch being 35’6” from the center line of Old Amesbury Road, with the stairs 30’4” from this center line.  The town owned portion of the road is approximately 16 ˝ feet from the center line on either side, thus a variance of 9 feet would be needed for the main porch and a variance of approximately 6 feet would be needed for the stairs. 

Mr. and Mrs. Farley met with the Board and presented their proposal.  It was noted that no abutters were in attendance, however, abutter Marcia York had provided a note stating, “I have no objections”.

The Board reviewed the five criteria for a variance approving all.  A hardship did appear to exist since the home was built in 1969 and the members agreed that the building of a farmer’s porch would not negatively affect other properties.  Joan Skewes moved to approve the application for variance, seconded by Dan Chaisson with all in favor.

 

Approval of May 4, 2004 minutes – John Andreasse moved to accept the minutes as written, seconded by Dan Chaisson with all in favor.

 

Dan Chaisson moved to adjourn at 8:26 pm, seconded by John Andreasse with all in favor.
