Zoning Board or Adjustment Minutes

May 6, 2003 Public Hearing/Meeting

Roll call: Joan Skewes, Paul Kimball, Eric Peterson, John Ronan, and newly appointed alternates, Richard Parker and Michael Motherway

     

The meeting was called to order at 7:39 p.m.

 

Continuation of the application for Variance.  ArcSource, Inc. has submitted an application requesting a variance from Article 9 II.6, III.4, and III.5. 

      At the last meeting, Paul Kimball had explained that the lot as shown is incorrect as not all of the lot is commercial, thus the hearing was postponed in order to obtain a determination from Town Counsel.  Initial review by Town Counsel had determined that all of the lot was in the commercial zone, however, after reviewing additional documents following investigation by staff, Attorney Tucker found that the commercial zone passed at Town Meeting included only a portion of the property along Route 150.  Attorney Salomon acknowledged he had received a letter from Attorney Tucker, but only a few days prior to this meeting, thus did not have enough time to submit a revised application and plan. 

      Public comments included G. Frank, of Cottage Road, who stated that when the Planning Board denied the Site Plan, they were never aware that part of the property was not commercially zoned.  Bill Ingram, Trundle Bed Lane, presented a tax bill for one acre with the remainder listed as farm land.  John O’Connor suggested the town research the exact parameters, as well as the applicants, to protect the Town’s best interest. 

      Attorney Salomon requested a continuance to the next meeting to allow time to research and redesign the plans.

      Joan Skewes moved to continue the hearing to June 3rd, the first Tuesday in June, with the stipulation that the applicant come with applications for all needed special exceptions, variances, etc., on the subject property, seconded by Eric Peterson with all in favor. 

 

John Doyle, consultation regarding a special exception for an in-law apartment – John and Ruth Doyle explained they had purchased their home 26 years ago.  A play room was built a few years ago, but slowly grew into an in-law-apartment that is only used four to five months per year.  The requirements were reviewed and Mr. & Mrs. Doyle will submit an application for the next meeting.

 

Approval of April 1, 2003 minutes  - John Ronan moved to accept the minutes of April 1, 2003 as written, seconded by Paul Kimball with all in favor.

 

Paul Kimball moved to adjourn at 8:37 pm, seconded by Eric Peterson with all in favor.
