June 4, 2002 Public Hearing/Meeting

The Meeting was called to order at 7:35 pm.
The Board
met with Philip and Tracey Walker, 6 Olivia Lane, Kensington, NH, regarding
their application for a Special Exception in accordance with Article 7.6 A2 of
the Wetland Conservation District to allow the erecting of a fence within the
setbacks allowed. Chairman Joan Skewes
explained that Mrs. Walker had met with the Conservation Commission and had
been referred to the Zoning Board of Adjustment for a special exception.
Mrs.
Walker reviewed in detail their plans to erect a fence along the property line
between their property and the Mahoney’s, which involves crossing approximately
40 feet of hydric B soils. Paul Kimball
asked for verification of how wet the area is.
The applicant explained that usually boots would be needed but there is
no pond or standing water, however, there is a very small stream that runs
through the properties during wet periods.
The fencing would be raised so that it would not impede any flow of
water.
Chairman
Skewes explained that the applicants would need to file an application with the
Department of Environmental Services Wetlands Board because of digging holes
for the posts. The wetlands application
will also need to be brought to the Conservation Commission for signing as well.
Tim and
Kathy Mahoney were present. Mr. Mahoney
said he has concerns that the fence crossing the stream will create a problem
with his property through blockage, damming, etc. Joan Skewes replied that the wetland review process would address
these issues, and K. Clark added that the application process is very
stringent.
Mr.
Mahoney played a video tape of the wetland area including the stream. He asked about oversight and if problems did
develop, what recourse he would have.
Joan Skewes said he could call the Wetlands Board, which would handle
the matter.
K. Clark
motioned that the application of Philip and Tracey Walker at 6 Olivia Lane,
requesting a special exception on their property to erect a fence within hydric
B soils as described in the application be approved conditioned upon not
impeding water flow, approval by the New Hampshire Department of Environmental
Services Wetlands Bureau, and approval by the Kensington Conservation
Commission. The motion was seconded by
Paul Kimball with all in favor.
