Minutes for Zoning Board of Adjustment

October 2, 2001 Meeting

Amended and approved November 6, 2001

 

Roll call: Dan Chaisson, Chairman, Joan Skewes, Katherine Clark, Paul Kimball, and John Ronan

 

The Meeting was called to order at 7:34 pm and was chaired by Joan Skewes.

 

R. S. Sanderson Builders continuance– requesting variances from provisions of the Wetland Conservation District, Article 7.5, Sections C & D, Specific Requirements of the Residential-Agricultural District, Article 8.2, III, B, and Septic Regulations 3.8.D, a., 6 and 3.c and d.  Attorney Pelech and Brad Jones of Jones and Beach Engineering met with the Board, presenting final plans.  Attorney Pelech explained that a Wetland Scientist had certified and stamped the plans, both wells had been located, the no-cut area had been increased to 30 feet and the limited cut area to 15 feet, the existing septic system had been located and the existing building was marked to be removed.  The Board again reviewed the restrictions to be filed with the deed.  The no-cut area will be flagged with orange fencing to be easily visible prior to construction and the building permit restrictions are to be reviewed completely prior to the start of any construction.  Dan Chaisson moved that they accept the plan, seconded by John Sargent with all in favor.  Katherine Clark expressed concerns about enforcement due to the fragility of the land and the importance of wetlands.  Joan Skewes explained that the Conservation Commission could enforce the restrictions.  Paul Kimball moved to approve the variances with the following conditions:  1) The no-cut zone is clearly delineated during the construction process with orange construction fencing for inspection purposes to be in place prior to excavation and throughout the process, and deed restrictions are incorporated with the deed.  Dan Chaisson seconded the motion with all in favor.

 

Robert Sweeney, Amesbury Rd. – consultation – Mr. Sweeney was not in attendance.

 

Approval of September 4, 2001 minutes – Paul Kimball moved to approve the minutes as presented, seconded by Katherine Clark with all in favor.

 

Processing cordwood was discussed and Denise will contact the Department of Agriculture for information regarding the commercial versus agriculture determinations.

 

Katherine Clark moved to adjourn at 8:10 pm, seconded by Joan Skewes with all in favor.
