Planning Board Minutes
August 17, 2010
Amended and Approved on September 21, 2010
In Attendance: Chairman M. Schwotzer, Kate Mignone, Peter
Merrill, Theresa Wojcukiewicz and Dylan Smith, Rockingham Planning Commission
Circuit Rider. Meeting called to order at 7:43 pm.
Chairman Schwotzer
moved to open the Public Hearing, seconded by Kate Mignone with all in favor.
PUBLIC HEARINGS
1. Conservation Commission and South East Land
Trust – Sargent property Lot Line
Adjustment – Joan Skewes and Rob Garneau attended for the CC. Joan explained that they were still waiting
for bank confirmation before proceeding but would like to clarify what the
Board would need for a plan. Dylan Smith
explained that the new lot line would need to be delineated and the plan would
need to show what was before and what’s left over; essentially making clear the
area being transferred. It would also
need to be in an acceptable form for recording at the Registry of Deeds. He added that the buildings, well and septic
did not need to be show, but the buffer area between the two would need to be
shown. John Sargent explained the
existing lots of record. Dylan Smith
offered to review any plans and continue to work with them. Theresa Wojcukiewicz moved to continue the
Public Hearing to September 21, 2010, seconded by Peter Merrill with all in
favor. The Board requested they let them
know if they are not ready at that time so they can continue it again if
needed. No public input.
2. Site Plan Review – 118 South Road, Kensington, NH, Map 4, Lot
38-4, for a Site Plan Review required as part of their Special Exception for
Home Occupation for a baking business.
M. Schwotzer explained that the Zoning Board of Adjustment had met and
essentially concurred that a reasonable interpretation of the condition was
that the applicants file within the time frame and process through the Planning
Board for approval; thus the Public Hearing can continue. The check list was reviewed. Currently there is no plan for a sign and
applicants agreed to obtain a permit if they do decide to do a sign. Members agreed to add as a condition that
there be no “eat in service”. Chief
LeBlanc had submitted a letter stating he was satisfied with the fire
protection at this time and has made provisions to inspect the premises
annually. Theresa Wojcukiewicz moved to
approve the Site Plan Review for Home Occupation for Hippie Chick Bakery with
the condition that there be no eat in service, seconded by Peter Merrill with
all in favor.
Peter Merrill moved to close the Public Hearing, seconded by Kate Mignone with all in favor. Theresa Wojcukiewicz needed to leave at this time and the members present agreed to continue as a work session as there would not be a quorum. Peter Merrill moved to the close the meeting at 8:27 pm, seconded by Theresa Wojcukiewicz with all in favor. The remainder of the minutes is relative to the work session.
WORK SESSION
NEW BUSINESS:
Master Plan – Michele Gagne - UNH Cooperative Extension’s Master Plan Assistance
· review Memorandum of Understanding
· outline the proposed process
Postponed to Sept. 21, 2010 at 7:30 pm.
OLD BUSINESS:
Discussion of Zoning
Ordinance and Land Use Regulations –
· Steep slope overlay district – Dylan Smith presented a proposal using a 20% or greater threshold. Peter Merrill questioned referencing soil type as well, but Dylan didn’t feel this was necessary. Dylan will review the erosion and sediment sections for improvement, revise and bring back a final draft for the Board. This would be a Warrant Article for Town Meeting; potentially under Chapter 2 as Article 11.
· Do not disturb areas – Discontinued.
Innovative planning – Development phasing
· Traffic discussion – Rte 150/107 – population growth and study data - Discontinued
· Letter of Credit requirement for each phase – Postponed.

Next Meeting – September 21, 2010
(Since this is my
last Planning Board meeting, the members thanked me for my years of
service. I was given a beautiful vase of
flowers and a tote bag full of goodies from Theresa Wojcukiewicz! It has been a pleasure working with all of
the Planning Board members and RPC circuit riders over the last 10+ years,
something I will definitely miss.
Kensington is very fortunate to have such proactive, educated and
dedicated volunteers, giving freely of their time and effort to move the town
forward as legal requirements demand, while maintaining the character unique to
this town. I have sincerely enjoyed
working with them all – an absolutely great group of people!)
